Butch Cassidy’s
personal lawyer, Douglas A. Preston, was born in Olney, Illinois on
December 19, 1858. He was admitted to the Illinois state bar twenty years
later, and ten years after that to the Wyoming state bar when he moved
west.
Preston developed a
friendship with Cassidy and represented him during Cassidy’s trial for
horse theft in the early 1890’s. At Cassidy’s request, Preston went to
Utah to represent Matt Warner during his trial over the
Coleman Affair.
Preston was spotted on the scene of the Wilcox, Wyoming train robbery by
members of the Wild Bunch.
Preston also helped
Cassidy in his failed attempt to go straight shortly before the Tipton,
Wyoming train robbery. Due to a train delay, Preston was unable to meet
with Cassidy to discuss the terms of the deal. Believing Preston to have
turned against him, Cassidy left a note…
“Damn you Preston,
you have double-crossed me. I waited all day but you didn’t show up.
Tell the U.P. to go to hell. And you can go with them.”
Cassidy returned to a
life of crime and his relationship with Preston was effectively severed.
In
1912 Preston married Anna Droullard, the couple had two children together.
Douglas A. Preston died on October 20, 1929.
